The use of our online store and the making of purchases by the visitor/user through it are determined and governed by the following terms and conditions. Before entering and using our online store, the visitor/user must read carefully and make sure that he/she has understood and that he/she agrees with these terms, rules, statements and conditions. The further use and browsing of the visitor/user on the website www.udive.gr implies his/her express and unreserved agreement and acceptance of the terms on his/her part.

Each visitor/user uses this website at his/her own sole risk and its content can in no way be considered to provide advice or inducement, direct or indirect, to users/visitors to take any action. udive.gr does not in any way state that the information included in the documents and announcements published on this website is suitable for any purpose.

By completing an order, you acknowledge that you are aware of and accept the Terms of Use and that all transactions to be carried out will be subject to the Terms of Use only. Please read the Terms of Use carefully and use our services only if you accept them.

If one of the Terms of Use is or becomes invalid, the validity of the remaining Terms of Use governing the operation of udive.gr will not be affected.

udive.gr reserves the right to unilaterally modify these terms and conditions of transactions made through this online store. udive.gr undertakes to inform users of any modifications and any changes through the website of this online store. It is clarified that the change of terms does not include orders that have already been placed.

The use of this website must be made exclusively for purposes that do not contradict applicable legislation, and the visitor/user must use it in accordance with the applicable legislation of the country in which he/she resides and not carry out acts or omissions that may cause damage or malfunction to it (website), or affect or jeopardize the provision of services through it. udive.gr bears no responsibility for the way in which the visitor/user uses the website and its services. udive.gr is not responsible for side effects, damages and any undesirable result resulting from the use of products-goods that the visitor/user ordered from it (website) and which are due to the wrong choice of products-goods by the user, careless or incorrect use of the products-goods, or to the manufacturer’s fault, such as a fault during manufacture, incomplete information or instructions accompanying the products-goods, quality of construction, material safety and material defects.

The responsibility of this (website) in the case of a defective product-good is limited to its replacement, provided that the conditions for returning products-goods are met. Visitors/customers are invited to use software to protect against viruses, or other harmful programs and elements.

udive.gr reserves the right to modify or suspend or discontinue for a short or long period of time all or part of the website, to change, improve or upgrade it, and any element and/or information included therein, without prior notice. udive.gr is not in a position to provide assurances regarding the complete absence of electronic viruses or other harmful programs.

udive.gr reserves the right to enter into an agreement for the assignment of its obligations to a suitable third party.

This website provides the content (information, names, photographs, illustrations, etc.), the products-goods and services available and their graphic representations through this website “as is”, without any warranty expressed or implied of any kind in any way. We are not responsible for inaccurate product-goods descriptions. The images of the products-goods are indicative. The control of the characteristics and suitability of the items ordered is the sole responsibility of the customer using this website. udive.gr cannot guarantee the correctness, completeness or availability, without errors, of the contents, services, options of this website or their results.

udive.gr, its employees, or other representatives, shall not be liable, under any circumstances, for any consequential, incidental, indirect, special damages of any nature, including but not limited to, lost profits, business interruption, loss of information or data, loss or damage to property, loss of goodwill, and any third party claims arising from or in connection with the use, copying, or presentation of this website or its contents or any other linked website, regardless of whether udive.gr was informed, knew or should have known of this possibility.

dive.gr shall not be liable for the performance of acts that contradict the applicable legislation with partial or total use of products-goods acquired from it (website). The visitor/user bears sole responsibility for the type of use of the products-goods acquired through a transaction from it (website). udive.gr bears no responsibility for the visitor/user’s communication with third-party service providers that appear on itself (website) and for any transaction or interaction that may arise from the relationship between them.

By using the udive.gr website and its services, you fully agree that the use is at your own risk. udive.gr makes every effort to provide a high quality service but it is not possible to guarantee that there will be no interruptions or errors. Any reference, photo, link and any content of any kind that refers to another website or third parties is provided for your convenience and udive.gr is not responsible for the contents, products-goods and services provided on them (another website or third parties), as well as any damage that may be caused by the use of the content found on udive.gr by other websites or third parties.

udive.gr is not responsible for any temporary or permanent inability to provide services and for delays in the acceptance and execution of orders and delivery of ordered products-goods due to force majeure, extreme weather events, natural disasters, emergencies, strikes, fire, malfunctions of cooperating courier companies, accidental deterioration or destruction of products-goods before delivery to the user and after they are given for shipment, illegal interventions by the counterparty or third party, malfunction of the Online Payment Processing provider (Bank) or the hosting service provider (Host Provider) or the Internet service provider (ISP) or the access service provider (Access Provider) or the user’s terminal equipment, incorrect provision of data by the user and in general for any incident that prevents the smooth fulfillment of its contractual obligations.

udive.gr is not responsible or liable for any damage (including compensation for moral damage) resulting from any errors, interruptions, defects or delays in the operation of the website, from the execution or non-execution of an order by a visitor/user, as well as from the inability to provide support services.

Orders, Payments, Shipping

The visitor/user can order products-goods via the Order form electronically from the udive.gr website, via e-mail at [email protected], by phone at 210 9766304 or via the Contact Form.

Shipping costs depend on the total weight of the order, the shipping method and the country of destination.

All orders are subject to acceptance by udive.gr. If an order is not accepted or canceled for any reason deemed necessary, the customer/user will be informed and in case the order was paid by card or deposit, the money will be refunded, subject to commission charges due to a transaction from a different bank, which the customer is charged.

In case of inaccurate registration of data during registration or ordering by the visitor/user, the visitor/user hereby accepts that he/she may have to compensate us for additional costs that may arise from the inaccurate data he/she registered.

The listed prices of the various products that appear on the udive.gr website are retail prices and include legal taxes. udive.gr reserves the right to change the prices and methods of shipping and completing an order/transaction without prior notice. The visitor/user is responsible for contacting udive.gr if he/she finds that a product-good is offered at an unusually low or high price in relation to its market value, before proceeding with its order.

The various product-good offers are valid until stocks run out. udive.gr cannot guarantee the availability of the displayed products-goods. In the event of unavailability of goods, the visitor/user will be informed as soon as possible so that his/her order can be canceled and the purchase amount refunded in case the order was paid for by card or deposit. The visitor/user may unconditionally proceed with a new order for another product-good of equal or different value.

Ownership of the products-goods is transferred after the full payment of the order price. The risk of loss or damage to the products-goods is transferred to the customer when he or a third party designated by him and is different from the carrier, has acquired physical possession of the products-goods.

Additional charges that arise in a shipment of products-goods (e.g. due to large volume/weight, remote location, shipping method, etc.) are covered by the customer. Shipments of products outside Greece are made only by credit card charge or by deposit and not by cash on delivery. udive.gr reserves the right to discontinue the cash-on-delivery service to any location without notice, and/or to refuse cash-on-delivery to visitors/users with incomplete shipping information, previous canceled orders or orders that have been returned or not received, or for any other reason deemed necessary, and to request payment of the order by card payment or deposit, in order to service it.

udive.gr reserves the right to vary the required time for the execution and delivery of an order in cases of force majeure, i.e. any event or condition that is outside the control of udive.gr and which could not have been foreseen and prevented, resulting in the inability to fulfill, in whole or in part, any obligation of udive.gr under the contract.

Shipments will be made to the location indicated by the customer/user who purchased products-goods from the udive.gr website, using one of the available shipping methods selected by the customer/user during the purchase process. Provided that the ordered product is immediately available in our warehouses and provided that there are no other reasons that force us to temporarily or permanently suspend the sales of a product, an effort will be made to ship within 24-72 hours depending on availability and workload. In case of unavailability of a product and estimated shipping time of the order exceeding five (5) days, the customer will be contacted to inform of the delay of the order or its cancellation. The goods are shipped and travel on behalf and under the responsibility of the customer. udive.gr is responsible for the products-goods and their condition until their delivery to the courier company cooperating with udive.gr. udive.gr is not responsible for any delay in the delivery of the products via the courier company.

Your orders are archived electronically and you can, if you wish, take note of the content of your order.

Warranty

The warranty is provided, if provided, by the manufacturer of the products-goods and not by the udive.gr online store. The store acts as an intermediary between the customer and the supplier for the repair or replacement of a defective product-good. The supplier, at their own discretion, undertakes to repair or replace the product-good. The manufacturer’s warranty covers the free repair of the good (labor and spare parts) due to normal use. Damage due to incorrect handling, force majeure and generally harmful external factors are not covered. The customer assumes the cost of transportation to and from the repair shop. Any additional costs not covered by the warranty are covered by the customer. The warranty does not apply in the event of intervention by an unauthorized technician. udive.gr does not provide a guarantee for the quality or suitability of the products sold for any specific purpose, nor does it guarantee the safety and protection of the users of these products.

In case of proven liability on the part of udive.gr for a real defect of a purchased product-good, the customer is entitled to request 1) the correction or replacement of the defective product-good without additional charge on his/her part, unless such action is impossible or requires disproportionate expenses. 2) the return of the product-good to udive.gr and the refund of part or all of the paid money to the customer. The above rights of the customer expire after 18 months.

Any warranty for purchased products-goods is valid only upon presentation of the product purchase document (retail sales receipt or invoice).

Cancellation, Withdrawal, Returns

Order Cancellation

An order can be canceled in the following cases:

1) Before the order is completed. During the online ordering process, the visitor/user can remove the quantities of products from his/her online cart.

2) Within a few hours of completing the order, as long as the product has not been prepared and received by the cooperating courier company. The customer must contact udive.gr immediately at 210 9766304 or via e-mail at [email protected] to immediately cancel their order.

In the event that an order that has been paid for by card or deposit is canceled and has not yet been received by a cooperating courier, the money will be refunded to the customer. Otherwise, the customer will be charged any shipping charges regardless of the order cost. udive.gr has the right to unilaterally offset its claim against the customer’s compensation due to damage caused by the customer.

Returns

The customer has the right to withdraw from the contract and return the products-goods purchased and received through udive.gr, without having to announce the reason for which he/she wishes to return the products-goods, within a period of fourteen (14) calendar days from the date the products-goods were received.

Returns are accepted only if the products-goods that the customer wishes to return are in the same condition in which they were received, in their impeccable original protective packaging without signs of use, together with the retail receipt or invoice as well as all accompanying documents and with the completed Withdrawal Form provided in this online store. In this case, the customer is only responsible for the costs of returning them.

In the event that the product-goods have been used or their original packaging has been altered by the customer, the return will not be accepted.

The products-goods are returned at the customer’s risk and full responsibility. Returns of products-goods that have been damaged by the customer will not be accepted under any circumstances.

In the event of a request to return a product-good that meets the return or replacement criteria and was acquired through a transaction with this website, udive.gr and its managers reserve the right to refund the visitor/user, or replace (Exchange) the product-good with the same or another product-good of equal or higher or lower economic value, with coverage of the monetary difference and any additional transportation costs by the customer or udive.gr respectively. In the event that the product-good does not meet the return or replacement criteria, no return or replacement will be made.

In any case, shipping of different products-goods (Exchange) or refunds will not be carried out until the returned products-goods have come into the possession of udive.gr and have been checked to determine their condition. Once the returned product-goods have been received and inspected, the customer will be informed via e-mail about the approval or rejection of the Change or refund.

In the event of a refund, it will be completed within fourteen (14) calendar days. The refund will be made in the manner in which the customer made the payment, unless otherwise agreed with the customer, without undue delay.

In the event that the products-goods are returned damaged or incomplete, udive.gr has the right to unilaterally offset its claim against the customer’s compensation due to a decrease in the value of the goods.

Since our products include products-goods that can be damaged or that are fragile and therefore sensitive products-goods, we inform you that these products are expressly excluded by law from the right of withdrawal. The criteria for determining the products-goods excluded from the right of withdrawal are defined by law, such as the fragile nature of the products, their ease of deterioration or their short expiration date, and have been determined based on common practice and on the manufacturers’ statements and relevant maintenance and preservation instructions, as they appear on the indications on the product labels, as well as cases where the products delivered are not suitable for return once unsealed for health protection or hygiene reasons.

The customer is entitled to a free replacement of the product-good with the packaging and shipping costs to be borne by udive.gr in case of sending the wrong product-good. If the product-good received by the customer is defective or damaged with proven responsibility of udive.gr, then the customer must immediately inform udive.gr via e-mail at [email protected], or by phone at 210 9766304. The product-good will be replaced immediately with udive.gr’s shipping costs or repaired in case it is covered by a warranty (with shipping costs, and any repair, of the customer) or the original price of the product-good will be reduced (i.e. a part of the amount of money is returned and the customer keeps the product-good) or a refund will be made without additional charges.

No return package will be accepted without prior consultation with a udive.gr representative. Any return and replacement (Exchange) of any defective products-goods must be made immediately and within three (3) days from the date of receipt, in their full packaging, with the retail sales receipt or invoice as well as all accompanying documents and with the completed Withdrawal Form provided in this online store.

In the case of worn or damaged packaging, the customer must not accept receipt of the product-good and must contact this online store immediately. Any return and exchange of any products-goods with damaged-worn packaging must be made immediately and without the customer receiving the product. In the event that the customer accepts to receive the product, udive.gr will not accept any return.

Returns cannot be made on custom-made products-goods, e.g. bulk speargun rubbers cut to a specific length ordered by the customer when ordering, ropes-fishing lines cut to a specific length ordered by the customer when ordering, custom-made diving suits.

Changes or returns are not accepted on products-goods that have been sold in offers of 50% or more.

udive.gr bears no responsibility for any damage or deterioration of the products-goods after their use and is not obliged to accept a return or replace these products-goods.

NO FULL REFUND CAN BE MADE WHEN CANCELLING ORDERED SERVICES THAT REQUIRE THE USE OF MATERIAL (e.g. rubber bands) IF THESE HAVE ALREADY BEEN PREPARED. The cost of the materials used will be borne by the customer. This condition also affects custom speargun setups (personalized spearguns) as well as tied ready-to-use rubber bands for conventional, roller, invert roller or fusion spearguns.

Newsletter

udive.gr provides the opportunity for visitors/users of its website to choose their information about new products as well as for any other offers by sending informative messages via telephone, e-mail or by post. The user/visitor who wishes to do so may request to stop receiving such messages.

udive.gr provides the ability to receive newsletters to visitors/users of this website at their email address, if they declare that they want this service. Subscribing to the udive.gr newsletter is not a mandatory procedure for making a purchase from the online store.
